New legal framework of concessions in Croatia

Abstract

At the end of 2012, Republic of Croatia put into force new Concessions Act, adjusted to the Proposal for a Directive of the European Parliament and of the Council on the award of concession contract from 2011. New Act is an important change on concession paradigm comparing to the one common in Croatia, particularly in the period prior to the Concessions Act from 2008. Concessions Act from 2012 is a wide and complete branch regulation that treats concession as a right given by a contract and ties three complex legal frames very tightly: concession, public procurement and public-private partnership. Strict implementation of policies from Treaty on the Functioning of the European Union is introduced, such as policy of market competition, policy of equal treatment, policy of banned discrimination, policy of mutual recognition, policy of linearity and policy of transparency.
