Abstract

For the acquisition of ownership, including the nationalization of a ship, ''titulus'' (legal title) and ''modus'' (modus of acquiring) are required. The district court decision by which a ship is declared the public property and as such entered in the registry, represents only ''modus'', but not the legal title for the acquisition of its ownership as well. The legal title is the decision of a competent administrative authority declaring the ship to be the public property. Particularly, the decision stating that the ship is submitted to the management of a certain authority, and that it is not nationalized, does not represent the legal title for the acquisition of its ownership. The court is not entitled to review the administrative decision with regard to the fulfillment of the conditions provided for in the nationalization act.
