Abstract

If the place for discharge of goods is clearly identified in a contract for carriage of goods by sea, it will be considered that the charterer neither had knowledge nor ought to have had knowledge of the vessels's characteristics relavant for the piering at the designated place. Therefore it is for the charterer to bear the consequences arising out of any impossibility for the vessel to berth at the contracted place even if the operator failed to give notice thereof to the charterer. It must be considered that the vessel arrived on time if she was ready for discharge of cargo at the agreed or usual time. If the vessel was not ready for discharge of the cargo, any waiting for working power does not represent a delay in discharging of such cargo.
