Abstract
Destruction of port handling equipment was recoverable as the cost of replacing the damaged equipment, alternatively as its market value at the time of the loss. There was not market for the equipment in Saudi Arabia. The value of such equipment in Europe could not be the same sat its value in Saudi Arabia. Since the latter value had to reflect the fact that such equipment has had to be transported to and imported into Saudi Arabia, and tropicalized. Claimants were entitled to recover the market or re-sale value of the equipment, whether or not they intended to replace it.
