Abstract

This paper contains a critical legal-historical analysis of the provisions concerning wedlock in Croatia since the end of World War II. The article attempts to prove the inappropriateness of the institute of non-existent marriage. It warns of the uselessness of empty phrases such as »Liberalism« or »Catholicism« that appeared in theoretical thought in new provisions in family law because it is evident that the State still has undoubted influence on the format of wedlock through its authority to inspect the presumptions prior to wedlock and issuing extracts from the Book of Marriages which his exclusive proof that marriage before a delegate of a religious community has its worldly effects.
