Horizontal cooperation agreements of shipping undertakings in tramp and liner shipping in competition law of the European Community

Abstract

The paper analyses horizontal cooperation agreements of shipping undertakings in the maritime transport sector. The most important horizontal agreements of liner shipping undertakings are certainly liner conferences. Liner shipping conferences have been granted some form of exemption from the competition rules in many jurisdictions, including the European Community.
In September 2006 the Council of ministers adopted Commission's proposal to repeal the exemption from the EC Treaty's ban on restrictive business practices (Article 81st of Treaty) for liner conferences on routes to and from the EU. The repeal will enter into force in October 2008. This marks the start of a new competitive regime in the maritime sector. In order to ease the transition to a fully competitive regime, the Commission in Sept 2007 issued Draft guidelines on the application of Article 81st of the Treaty to maritime transport services in which it deals mostly with horizontal cooperation agreements of shipping undertakings in the maritime transport sector, information exchange agreements in liner shipping and pools in tramp shipping.
