INDIVIDUAL usE of general – usE goods in Croatia: Ranges and limitations

Abstract

General- use goods are common goods in general usage. The use of general- use goods can be communal and individual. Communal use of general -use goods is anonymous and impersonal, free and equitable. In principle it is free and must be appropriately designated.
Individual use of general- use goods can firstly be in the interest of the public as in the construction of buildings for public needs as well as in the implementation of certain public services, and secondly for carrying out economic activities in the interests of the individual user of that good.
Individual use of general-use goods extends the boundary of its communal use. For such use, the special consent of public legal bodies is necessary. Such particular consent can be in the form of an administrative act or awarding concessions or formulating contracts on public-private partnership and finally also in the form of civil legal work with the issuing of general- use goods for rental or lease.
In this paper, certain legal fundamentals of the individual use of general -use goods are analysed as are the peculiarities of the legal regulation of each of these legal fundamentals.
