Sažetak
If between an agent and another person exists a permanent legal relation from which arises that the agent acts as an agent, not in his own name, it should be considered that he acts as an agent, even if this is not specially mentioned in the contract.
This capacity becomes particularly obvious if the order which the agent gives to a specific person bears his stamp which shows that he acts as an agent, and the order relates to the ship for which the agent was acting as an agent.
If in the timely appeal it is stated that the explanation will be given afterwards, and the explanation is delivered to the court after the prescribed term has expired, the court will not take into account the assertations contained in the explanation.
