Sažetak
The book studies various aspects of migrant smuggling by sea as a current threat to maritime security within the existing framework of the international law and state practice. Its aim is to determine the real efficiency of the existing system of the international law of the sea in the fight against the crime of migrant smuggling by sea.
First, the factual background to the problem is described at the international level, with a special focus on the southern Mediterranean region. Thereby, migrant smuggling by sea is qualified as a threat to the national security and the fastest-growing transnational organized crime today.
The distinction between migrant smuggling and human trafficking is drawn and the reader is introduced to the positive international law dealing with this area. Special attention is devoted to the UN Convention against Transnational Organized Crime, Palermo 2000, and the supplementing Protocol against the Smuggling of Migrants by Land, Sea and Air, Palermo, 2000. The author analyses the methods and means of exercising state policies and the protection of public interests in combating the crime of migrant smuggling. She discusses the states’ various specific operational and technical approaches to the practical aspects of combating the crime, especially through the implementation of the ISPS Code and the SOLAS Convention.
The author further analyses the powers and constraints of the states in the fight against migrant smuggling within various maritime zones according to the valid international law of the sea. Special attention is devoted to interception as a unilateral state practice. The humanitarian aspect of the problem is studied, including the principles of human rights and the duty to rescue all persons in danger at sea. The author thoroughly discusses various forms of international cooperation in combating the organized crime of migrant smuggling. She assesses the efficiency of the positive legal regime and the existing state practice. Using the examples of Australia, the USA and the EU, the author provides an analysis and a critical review of the practical difficulties that the states face when dealing with the problem of migrant smuggling. The departure of the state practice from what is strictly necessary and lawful is pointed out. It is suggested
that such state practice should be considered a signal and a possible way forward in the future development of international law.
This is an excellent monograph containing a thorough critical analysis of a current international problem; as such, it will be an important and valuable source for both scholars and professionals, as well as for the state administration.
