USE OF FIREARM AS INSTRUMENT OF FORCE IN RH WITH COMPARATIVE REVIEW ON SOME EUROPEAN STATES

Sažetak
Use of instruments of force is the hardest intervention which state is authorized to attempt towards the individual, and the most extreme one is usage of firearm. Our intention here is to introduce how this is issue is regulated in our legal svstem, and to show how the usage of firearm by the police forces is not completelv regulated and simplified as it is expected to be in a state which suppose to indulge high demands of protection of human rights and on the other hand, to accomplish efficiencv of police forces whose role is to proteci the most important social values. I is necessary to find balance between the legal protection of human right and restriction of police proceeding and efficiencv, so that one would not jeopardizing the other. This work is just the first step to solve that problem.
