Sažetak

Interim orders are important means to secure claims. Their value in practise depends on the statutory regulation of the requirements for their issuance and their interpretation in case law. The most important condition for an interim order to be granted is the existence of a monetary or non-monetary claim – the object that is to be secured. The other requirement varies depending on the nature of the claim and in some countries also the aim of the interim order – the securing of future enforcement or a temporary regulation of the legal relation in dispute. The article presents different systems of the provisional securing of claims in Slovenia, Croatia, Austria, and Germany and compares the relevant requirements, the existence of which has to be demonstrated by the petitioner in order to succeed in securing the claim against the debtor.
