Administrative Contracts and Administrative Judicial Trial

Abstract
In this paper, the authors analyze administrative contracts and judicial protection in relation
to administrative contracts. Administrative contracts were introduced into Croatian legislation
with the adoption of the General Administrative Procedure Act in 2010. Namely, until 2010 and
the adoption of the new General Administrative Procedure Act, our legal system did not provide
for administrative contracts, although there were numerous contracts that, by their characteristics,
corresponded to today’s definition of administrative contracts. The introduction of administrative
contracts into the General Administrative Procedure Act represented a major innovation and change
that meant that the provisions of the General Administrative Procedure Act apply to administrative
contracts, and supervision over their conclusion and execution is placed under the jurisdiction of
administrative courts based on the provisions of the Administrative Disputes Act, which entered into
force on 1 January 2012. With this regulation of administrative contracts, they first of all acquired
a public law character, and thus fell under the supervision of administrative courts, which is the
subject of this paper.
