Salvage Award to Crew Members of the Salving Ship

Sažetak
Crew members of the salving ship have a payable claim that grants them a conditional right to bring an action. After the expiry of one year from the termination of the salvage operations each crew member of the salving ship may take legal action against the ship operator, claiming his salvage apportionment of the award, provided the salvor itself has not instituted the claim. If out of several crew members only one (claimant) claimed the salvage award, he is not entitled to the salvage award in the full estimated amount but is entitled to a corresponding award. Each crew member of the salving ship may receive a salvage award only to the extent of his share of that award. This means that the crew members of the salving ship are not joint creditors and that an individual crew member is not entitled to the payment of the salvage award in the entire estimated amount.
