Control over the Administration through Supervision of the Execution of Administrative Court Decisions

Abstract
The authors of the paper analyze the control over the administration through the supervision of the
execution of administrative court decisions, with a special emphasis on the Administrative Disputes
Act of 2024. In the introductory part, the authors emphasize the importance of the execution of
court decisions as an important element of the rule of law, without which parties cannot exercise the
right to a fair trial. After the introductory part, the execution of administrative court decisions under
previous regulations is analyzed. The central part analyzes the provisions of the new Administrative
Disputes Act, which entered into force on July 1, 2024, which regulated the issue of the execution
of administrative court decisions in more detail and specifically. The new Act specifically regulated
the issue of the execution of administrative court decisions with an emphasis on strengthening the
mechanisms for the forced execution of court decisions and the responsibility of heads of public law
bodies for the execution of administrative court decisions. The role of the court has been expanded to
include active supervision of execution. An analysis of case law shows that the new legal framework
increased efficiency, legal certainty and protection of the rights of parties.
