Abstract

The search of persons, given its legal characteristics, represents a specific action and, as such, requires special treatment of individuals on whom it is performed by police, customs, and judicial officers. Particular attention should be paid when searching or examining transsexual, transgender, and gender non-conforming persons. The paper discusses the 2013 legislative amendment that allows the registration of a gender change in personal documents without adjustment of primary or secondary sex characteristics to that gender, and examines the effects of this legal provision on statutory and subordinate legislation concerning the search and examination of persons. The first part analyzes the Criminal Procedure Act, the Police Affairs and Powers Act, the Customs Service Act, and the Act on the Execution of Prison Sentences, while the second part discusses case studies and the difficulties encountered in conducting such searches and examinations under the existing legal framework.
