Abstract

Jacques Maritain (1882-1973), a French philosopher („famous Thomist”), political and constitutional writer who in his opus – especially in the text: Man and The State (1951) varies the notion of sovereignty
i.e. the notion of phenomenon which mirrors its „philosophical“, „political“ and „constitutional“ dimension. Prior to Maritain`s idea of sovereignty phenomenon of monarchic (pre Bodin,Bodin and Hobbes) and public (pre Rousseau and Rousseau) sovereignty were mostly problematized. With the intention of formulating „a concept“ of sovereignty, Maritain focuses predominantly on the sovereignty concepts of Bodin, Hobbes and Rousseau. Maritain concludes that, taking into consideration „healthy“ political philosophy, there is no sovereignty in a political society, or on other words no natural or inalienable right to supreme transcendental or separated power. Maritain claims that, resulting from this defi nition of sovereignty, the real sovereigns were not dukes, kings or emperors even though they carried the sword and all the attributes of sovereignty. The only sovereign is God.
