Abstract

In modern democratic societies armed forces are subordinate to the will of the civil government. The democratic control of the Croatian Armed Forces (CAF) became a constitutional term in 2001. Since then, the legislature has established, changed or amended a scope of authority to employ the CAF and to control its employment. An intuitive, simplified and situational approach to these issues has led to different interpretations of authority and responsibility for command and control of the CAF. A consequence of such an approach is the creation of significant constitutional and legal disputes among various stakeholders in decision-making processes at the national strategic level of command.
This research paper investigates the causes and effects of these disputes and points out the inconsistency and contradiction of some of the resolutions. It also discusses the need for a unified understanding of the concepts of command and management of the CAF as well as its preparation and employment.
In addition, the author emphasizes some additional issues which should be taken into account in a systemic and transdisciplinary approach to these disputes in the future.
